1. ACCEPTANCE OF TERMS
Welcome to www.elederayos.online (the "Website"). These Terms of Use ("Terms") constitute a legally binding agreement between you ("Client" or "you") and Ele de Rayos ("Provider," "I," "me," or "my"), operating in Mexico.

By accessing or using the Website and its services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Website or Services. You confirm that you are at least 18 years of age.

2. SERVICES & ROLE OF THE PROVIDER

2.1. Nature of Services.
Ele de Rayos operates under the brand Deep Mind Fixer / Master of Deep Transformations. I provide various services in the field of deep transformation (including but not limited to Deep Reboot Immersive Intensive, training, consultations). The specific name, format, and content of the Service are agreed upon individually with each Client prior to payment.

2.2. My Role: The Facilitator.
I act as a facilitator, creating a confidential and safe space for your own internal work. My responsibility is strictly limited to providing this space, my focused attention, and the questions or perspectives I offer as part of the process.

2.3. What My Services Are NOT.

They are NOT psychotherapy, psychiatric care, psychological counseling, or medical treatment of any kind.
They are NOT a substitute for the diagnosis, treatment, or cure of any mental health condition or psychological disorder.
They are NOT professional financial, legal, or medical advice.

2.4. No Guarantee of Outcomes.
Results from the Services are subjective and depend entirely on the Client's personal engagement and internal processes. I do not promise, guarantee, or warrant any specific outcome, result, or "fix."

2.5. Critical Disclaimer for Crisis Situations.
IF YOU ARE EXPERIENCING A MENTAL HEALTH EMERGENCY, SUICIDAL THOUGHTS, OR SEVERE PSYCHOLOGICAL DISTRESS, THESE SERVICES ARE NOT APPROPRIATE FOR YOU.
You must immediately contact your local emergency services, a licensed psychiatrist, psychologist, or a crisis helpline.
By engaging in the Services, you confirm that you are not seeking help for a clinical condition and that you understand this critical distinction.

3. CLIENT'S RESPONSIBILITY & INFORMED CONSENT

3.1. Your Sole Responsibility.
You retain full and exclusive responsibility for your own well-being, interpretations, insights, decisions, actions (or inactions), and all consequences arising from our sessions. You agree that Ele de Rayos is not and cannot be held liable for any emotional distress, perceived missed opportunities, financial losses, life choices, or any other direct or indirect consequences you may attribute to the Services.

3.2. Informed Consent.
By booking and paying for a Service, you provide your informed consent to participate in this facilitative process, fully understanding its nature and limitations as described in these Terms.

4. FINANCIAL TERMS: PAYMENT & REFUND POLICY

4.1. Currency, Pricing, and Payment Method.

All prices for Services are set and fixed in United States Dollars (USD). Prices listed on the Website in USD are final.
Payment is made exclusively in Mexican Pesos (MXN) via an individual payment link (invoice) that I send after we agree to work together.
The amount in MXN on the invoice is calculated using the current USD/MXN exchange rate at the time the link is generated. The Client pays the exact amount in MXN specified in the invoice.

4.2. The Principle of Rendered Service.

Any Service is considered rendered from the moment it begins at the agreed-upon time. My obligation is to be present and conduct the Service in full.
By paying for a Service, you are purchasing my time, presence, expertise, and the created space, not a guaranteed subjective outcome.

4.3. Cancellation & Rescheduling by the Client.

You may cancel or reschedule a Service by notifying me at least 24 hours before its start time.
In case of cancellation with 24+ hours notice, you will receive a refund of the amount paid in MXN, minus the non-refundable payment processing fee (see clause 4.5).
Cancellation with less than 24 hours notice, a no-show, or arrival more than 15 minutes late is treated as a rendered service and is non-refundable.

4.4. Refunds After Service Commencement.

A refund after a Service has commenced may be considered solely at my personal discretion in exceptional circumstances (e.g., a proven technical failure on my part that made conducting the Service impossible).
Dissatisfaction with the process or lack of a desired effect is not grounds for a refund.

4.5. Payment Processor Fee on Refunds.

The payment processor (Stripe) charges a fee for processing both the incoming payment and the refund. This fee is non-refundable.
Therefore, any refund issued under clause 4.3 will be for the amount in MXN received from you, minus the payment processor's fee (typically 4-5%). The Client bears any exchange rate losses during the refund conversion.

5. CONFIDENTIALITY

5.1. My Commitment. I uphold absolute confidentiality regarding all information you share. No session records, notes, or archives are stored after our engagement concludes.

5.2. Separate NDA. For an added layer of protection, a separate Mutual Non-Disclosure Agreement (NDA) is available upon request and is strongly recommended. For certain Services, I may require the signing of an NDA as a precondition to our work. In such cases, the Service will only commence after the signed NDA is returned to me.

6. INTELLECTUAL PROPERTY

6.1. Ownership. All content on the Website, including text, graphics, logos, and structure, is the property of Ele de Rayos and is protected by international copyright laws.

6.2. Authored Content. The Website features unique artistic concepts, methodologies (such as "Deep Reboot"), and imagery created with the assistance of artificial intelligence, authored by Ele de Rayos.

6.3. Restrictions. You may not reproduce, distribute, modify, or commercially exploit any part of the Website's content without my express prior written permission.

7. ACCEPTABLE USE & PROHIBITED CONDUCT
You agree not to use the Website or Services to:

Harass, abuse, or harm others.
Transmit harmful or illegal content.
Attempt to gain unauthorized access to the Website's systems.
Engage in any activity that violates applicable laws in Mexico or your jurisdiction.
Use any content from the Website or Services for commercial purposes without prior written consent.
Record, capture, or distribute any part of the sessions without my explicit prior consent.

8. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Ele de Rayos shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Website or Services. My total liability for any claim is strictly limited to the amount you paid for the specific Service giving rise to the claim. This limitation does not apply in cases of gross negligence or willful misconduct.

9. THIRD-PARTY LINKS

The Website may contain links to external platforms (e.g., WhatsApp, social networks). I do not control and am not responsible for the content or privacy practices of these third-party sites.

10. PRIVACY
Your privacy is paramount. My data handling practices are detailed in a separate Privacy Policy available at https://www.elederayos.online/privacy-eng. In short: I do not store or share your personal data beyond what is necessary for the single Service rendered.

11. GOVERNING LAW & DISPUTE RESOLUTION
These Terms are governed by and construed in accordance with the laws of Mexico. Any dispute arising from these Terms or the Services shall be subject to the exclusive jurisdiction of the competent courts located in Mexico City, Mexico.

12. CHANGES TO THE TERMS
I reserve the right to modify these Terms at any time. The updated version will be posted on the Website with a new "Effective Date." Your continued use of the Services after any changes constitutes your acceptance of the new Terms.

13. Force Majeure
Neither party shall be liable for any failure or delay in performing its obligations under these Terms if such failure or delay is caused by circumstances beyond its reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials ("Force Majeure Event"). The affected party shall notify the other party promptly and use reasonable efforts to mitigate the effects of the Force Majeure Event.
